This publication was prepared toВ inform members ofВ the business community as well as inventors ofВ the world about Russian patent attorneys.

Russian patent attorneys are specialists inВ the field ofВ protection and registration ofВ intellectual property rights, who have passed the state certification inВ the Federal service for intellectual property (Rospatent) and can represent the interests ofВ foreign applicants before Rospatent.

Russian patent attorneys may be certified inВ respect ofВ nine different objects ofВ intellectual property and represent the interests ofВ the principals before Rospatent, depending on the specialization obtained as aВ result ofВ certification, upon receipt ofВ Russian patents for inventions, utility models, industrial designs, and upon registration ofВ trademarks, service marks, appellations ofВ origin ofВ goods, computer programs, databases and topologies ofВ integrated circuits inВ Russia.

Among the Russian patent attorneys, there are attorneys who have also passed additional certification at the Eurasian patent office (EAPO), and have the status ofВ Eurasian patent attorneys, which allows them toВ represent the interests ofВ the principals before the EAPO inВ obtaining Eurasian patents for the invention, which operate inВ eight CIS States that are States parties toВ the Eurasian patent Convention, including inВ Russia.

The main activity ofВ patent attorneys is aimed at identifying the essence ofВ inventions and utility models, and compiling their descriptions and formulas that provide the maximum amount ofВ exclusive rights acquired as aВ result ofВ registration, and also consists inВ the correct preparation and execution ofВ sets ofВ documents necessary for obtaining patents for inventions, utility models and industrial designs, as well as for registration ofВ trademarks, service marks and appellations ofВ origin ofВ goods, computer programs, databases and topologies ofВ integrated circuits.

According toВ Art. 1247В ofВ the Civil Code ofВ the Russian Federation, aВ citizen ofВ the Russian Federation permanently residing inВ its territory may be registered as aВ patent attorney. Other requirements toВ the patent attorney, the procedure for its certification and registration, as well as its competence inВ relation toВ the conduct ofВ cases related toВ the legal protection ofВ the results ofВ intellectual activity and means ofВ individualization are established byВ law.

Citizens permanently residing outside the territory ofВ the Russian Federation and foreign legal entities conduct business with the Federal Executive body for intellectual property through patent attorneys registered with the said Federal body, unless otherwise provided byВ an international Treaty ofВ the Russian Federation.

InВ the Russian Federation it is the Federal law ofВ December 30, 2008В N 316-FZ В«About patent attorneysВ» inВ which more extended definition ofВ the patent attorney is given:

В«Patent attorneys are citizens who have received the status ofВ aВ patent attorney inВ accordance with this Federal law and carry out activities related toВ the legal protection ofВ the results ofВ intellectual activity and means ofВ individualization, protection ofВ intellectual rights, acquisition ofВ exclusive rights toВ the results ofВ intellectual activity and means ofВ individualization, disposal ofВ such rights.

As aВ patent attorney may be certified and registered citizen ofВ the Russian Federation, which:

1) has reached the age ofВ 18В years;

2) permanently resides inВ the territory ofВ the Russian Federation;

3) has higher education;

4) has at least four years ofВ experience inВ the field ofВ activity ofВ aВ patent attorney inВ accordance with the specialization, inВ relation toВ which aВ citizen expresses aВ desire toВ be certified and registered as aВ patent attorney.В»
